By accessing this website and placing an order, you agree to be bound by the following terms and conditions.
1. Eligibility and Accounts
Account Security: If you create an account, you are responsible for maintaining the confidentiality of your password and for all activity occurring under your account.
2. Orders and Pricing
Order Acceptance: Your order is an offer to purchase. We reserve the right to refuse or cancel any order at our sole discretion, including after confirmation.
Michigan Sales Tax: A 6% sales tax applies to all tangible personal property sold (flowers, plants, etc.).
Tax-Exempt Delivery: In accordance with Michigan law effective April 26, 2023, delivery charges are exempt from the 6% sales tax provided they are separately stated on your invoice.
Pricing Accuracy: Under Michigan’s Shopping Reform and Modernization Act, we strive for pricing accuracy. If a price is incorrectly displayed online, we will notify you before processing the order.
3. Substitution Policy
Seasonal Variations: Due to nature and seasonal availability, substitutions of equal or greater value may be necessary to ensure the freshest quality.
Artistic Discretion: While we aim for visual similarity to website photos, the final arrangement may vary in style and flower variety.
4. Delivery Policy
Recipient Availability: It is your responsibility to ensure the recipient is available. If they are not present, our couriers may leave the flowers in a secure area (e.g., porch) at their discretion.
Accuracy: You must provide a complete and correct street address, including apartment or suite numbers. We are not responsible for deliveries delayed or failed due to incorrect information.
Time Windows: We cannot guarantee specific delivery times, especially during peak holidays (e.g., Valentine's Day, Mother's Day).
5. Cancellations and Refunds
Cancellation Window: Orders for standard arrangements must be cancelled at least 48 hours prior to the scheduled delivery date.
Freshness Guarantee: We provide a 48-hour guarantee on the freshness of cut flowers. If you are unsatisfied, you must contact us within this timeframe.
Refund Process: Approved refunds for pricing errors or non-delivery must be requested within 30 days of the transaction.
6. Consumer Protection
Floral Transaction Act: In compliance with the Michigan Floral Transaction and Consumer Protection Act, we clearly state our physical business location and do not use deceptive geographic origin representations.
Prohibited Practices: We adhere to the Michigan Consumer Protection Act, which prohibits deceptive trade practices and misrepresentation of goods.

7. Updates to the Terms and Conditions
We reserve the right to update these Terms and Conditions. When these Terms and Conditions are updated - the above "Last Updated" date will be updated accordingly.
8. Governing Law
These terms are governed by the laws of the State of Michigan. Any disputes shall be resolved in the courts of Oakland County, Michigan.
